1. Who you are contracting with
These Terms & Conditions ("Terms") form a binding agreement between you and Jamerican Travel LLC ("Jamerican Travel," "we," "us"), the provider of the Jamerican Travel website, membership, AI itinerary planner, and related services (the "Service").
2. Acceptance
By creating an account, subscribing to a plan, or otherwise using the Service, you agree to these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization. If you are an individual, you confirm that you are of legal age in your jurisdiction.
3. The Service
Jamerican Travel provides travel planning tools including saved trips, curated guides, AI-generated itineraries, and (for Business Partners) marketplace listings. Specific features depend on the plan you choose.
4. Accounts and accuracy
You are responsible for keeping your account credentials confidential and for all activity under your account. You must provide accurate information and keep it up to date.
5. Acceptable use
You must not:
- use the Service for any unlawful purpose, fraud, or spam;
- infringe the intellectual property or privacy rights of others;
- upload malware or interfere with the security or integrity of the Service;
- scrape, probe, reverse engineer, or attempt to circumvent technical limits;
- resell or redistribute the Service without our written consent.
6. AI-generated content
Our AI itinerary planner produces output based on your prompts and third-party models. You are responsible for your prompts, for how you use any output, and for verifying the accuracy of suggestions (including travel advisories, prices, opening hours, and safety information). Output is provided for general planning purposes only and is not professional travel, legal, medical, or financial advice. You must not use the Service to generate illegal content, deepfakes, hate speech, or to attempt to jailbreak the underlying models. We may filter, refuse, or remove outputs and may suspend accounts that misuse the Service. We respond to good-faith rights-holder takedown requests at legal@jamericantravel.com and may terminate repeat infringers.
7. Intellectual property
The Service, including its software, content, and branding, is owned by Jamerican Travel LLC or its licensors. We grant you a limited, non-exclusive, non-transferable right to use the Service within your active plan. You retain ownership of content you submit and grant us a limited license to host and process it solely to provide the Service.
8. Payments, subscriptions, and refunds
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, taxes, cancellation, and refund mechanics are governed by Paddle's Buyer Terms. Subscriptions renew automatically at the cadence shown at checkout until cancelled. 9. Suspension and termination
We may suspend or terminate your access for material breach of these Terms, non-payment, suspected fraud or security risk, or repeated or serious policy violations. You may cancel your subscription at any time via the billing portal. On termination, your right to use the Service ends; we may delete account data after a reasonable export window.
10. Service level and warranties
The Service is provided "as is." We do not guarantee that it will be uninterrupted, error-free, or that AI output will be accurate. To the fullest extent permitted by law, we disclaim all implied warranties including merchantability and fitness for a particular purpose.
11. Liability
To the fullest extent permitted by law, our aggregate liability arising out of or related to the Service is limited to the fees you paid us in the twelve months preceding the claim. We are not liable for indirect, consequential, or special damages, including loss of profits, data, or goodwill. Nothing in these Terms excludes liability for fraud, death, or personal injury caused by our negligence, or any other liability that cannot be excluded by law.
12. Indemnity
You agree to indemnify Jamerican Travel LLC against claims arising from your content, your unlawful use of the Service, or your breach of these Terms.
13. Governing law
These Terms are governed by the laws of the State of Florida, USA, and disputes are subject to the exclusive jurisdiction of the courts located there, except where mandatory consumer law applies in your country of residence.
14. Changes
We may update these Terms from time to time. Material changes will be communicated through the Service or by email. Continued use after changes take effect constitutes acceptance.
